Client work is governed by a signed agreement

This website describes our services but is not an offer or a contract for them. Paid work starts only under a written agreement signed by you and KVM. If that agreement conflicts with these terms, the agreement controls. Our Refund Policy explains billing and cancellation where an agreement doesn't say otherwise.

Results and examples

Marketing results depend on many things outside our control, including your market, offer, pricing, budget, competition, follow-up, and the advertising platforms themselves. Case studies, figures, and testimonials on this site describe specific past clients. They are not typical or guaranteed results, and your results will differ. Nothing on this site is a promise of any particular number of leads, sales, or return on ad spend.

Blog posts and other content are general information, not legal, tax, financial, or other professional advice for your situation.

Your use of the site

• Give accurate information when you fill out a form, and only your own contact details.
• Don't misuse the site: no attempts to break in, overload it, scrape it at scale, send spam through its forms, or use it for anything unlawful.

Text message and call program

If you check the box on our growth assessment agreeing to calls and texts, KVM may contact you at the number you gave about your inquiry, your booked call, and our marketing services, including by automated technology. Consent is not a condition of any purchase.

• Message frequency varies. Message and data rates may apply.
• Reply STOP to any text to opt out. You'll get one message confirming you're opted out, and no further texts after that.
• Reply HELP for help, or email kent@kvmcreativeagency.com.
• Carriers are not liable for delayed or undelivered messages.
• Your mobile information is handled as described in our Privacy Policy and is never shared with third parties for their marketing.

Emails

If you sign up for our newsletter or request a resource, we'll send you emails about marketing for local service businesses. Every marketing email has an unsubscribe link.

Intellectual property

The site's text, design, graphics, logos, and videos belong to KVM or are used with permission. You may view and share links to our pages, but don't copy, republish, or sell our content without written permission. Client names, logos, and trademarks shown on this site belong to their owners and appear to describe our work, not to suggest endorsement beyond what is stated.

If you believe something on this site infringes your copyright or other rights, email kent@kvmcreativeagency.com with the details and we will review it promptly.

Third-party services and links

The site uses and links to services run by others, such as our booking calendar, Vimeo, Meta, and Instagram. Their own terms and privacy policies apply to them, and we aren't responsible for their content or practices.

Disclaimer

The site and its content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the site will always be available, error-free, or free of harmful components.

Limitation of liability

To the fullest extent the law allows, KVM will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of this website. Our total liability for any claim arising from your use of this website is limited to one hundred US dollars. This section does not limit liability that cannot be limited by law, and it does not change the terms of any signed client agreement.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute about these terms or the site will be brought in the state or federal courts located in Orange County, California, and you and KVM consent to those courts.

Changes

We may update these terms. The date at the top of this page shows the latest version, which applies from that date forward.
